Councilman Cleve Dunn Jr. wants indictment thrown out

BATON ROUGE — Baton Rouge Councilman Cleve Dunn Jr. wants a judge to throw out his indictment for corruption charges, court records show.

Dunn filed a motion Tuesday asking for the indictment to be quashed, accusing the Attorney General's Office of overstepping its bounds. It is similar to the one filed by the team of also-indicted EBR Schools Superintendent Lamont Cole.

Dunn's lawyers argue that the AG's Office cannot prosecute without a written request from the district attorney.

Dunn, Cole and several other sitting and former East Baton Rouge officials were indicted in a sweeping corruption investigation by the AG.

Prosecutors accuse Dunn of participating in kickback schemes tied to the Capital Area Transit System.
