BATON ROUGE — Defense attorneys in the Madison Brooks trial put in a motion to dismiss all charges for Desmond Carter, saying prosecutors leaked evidence to on-air personality Nancy Grace.

Arrest documents say Brooks, a 19-year-old LSU student, left Reggie's Bar with Carter, Casen Carver, Kaivon Washington and Everett Lee in the early morning hours of Jan. 15, 2023. The group went to a parking lot, where Washington and Carter are accused of raping Brooks in the backseat of Carver's vehicle.

The men told officers that Brooks requested to go home and they took her to an address in the Pelican Lakes subdivision and dropped her off. After they left, Brooks wandered into the roadway and was hit and killed by a rideshare driver.

On Oct. 28, Grace said on her program "Crime Stories" that she'd seen videos of the alleged sexual assault. Grace says to guest Dr. Bethany Marshall that both of them saw "the video they took of Maddie being allegedly sex assaulted," and that she finds it "very hard to believe... that any of that was consensual."

Carter's defense said that the video was designated as contraband by the state, and the defense believed the video was solely in the state's possession.

"The state appears to have caused the very prejudice that now threatens Mr. Carter's right to an impartial jury after a video or videos the state deemed contraband — material that, to the defense's knowledge, was and remains in the state's sole possession — somehow reached television host Nancy Grace," the defense says.

Additionally, the defense asked all evidence discussed on the national program be excluded at trial if prosecutors don't comply.

The trial is currently set for Dec. 7.
